Criminal Domestic Violence Prosecutor
The candidate reviews and evaluates criminal domestic violence cases for General Sessions Court and Magistrate s Court. Conducts conferences with victims, witnesses, law enforcement personnel, public defenders, private attorneys, other solicitors, magistrates, probation and parole personnel, judges, and defendants; performs legal research and prepares memorandum; reviews and prepares motions, orders, and correspondence; evaluates crime scene investigations, etc. Performs advance preparation for court terms, including such duties as making victim-witness and law enforcement contacts; trial roster and plea list preparation and distribution; conducting prosecution team meetings and coordination of triallists of subordinates; allocation of available court time; review of cases-pending printouts; and pre-trial negotiations. Attends and participates in General Sessions Court and Magistrate s Court trials, motion hearings, guilty pleas, in-chamber judicial conferences, and case negotiations. Performs miscellaneous administrative functions, including providing general legal advice and assistance, participating in law enforcement training, coordinating with Magistrate Court personnel to set trial docket. Attends meetings, conferences and seminars as necessary. Receives, reviews and evaluates various records and reports related to casework including incident reports, victim/witness statements, case file reports, warrants, discovery requests, affidavits, citations, NCIC reports, confessions, criminal histories, trial rosters, dockets, juror lists, medical reports, autopsy reports, laboratory reports, fingerprint reports, SLED reports, court orders, hospital records, business records, bank records, photographs, etc. Prepares, files, petitions, alibi requests, legal memoranda, affidavits, motions, plea agreements, subpoenas, court orders, requests for dismissal, witness lists, trial rosters, plea lists, photographs, exhibits, etc. Operates a variety of equipment such as a computer, printer, Dictaphone, copier, fax machine, pager, audiovisual equipment, tape recorders, calculator, vehicle, telephone, etc. Interacts and communicates with various groups and individuals such as the Solicitor, other staff members, County Council, law enforcement agencies, public defenders, private attorneys, defendants, witnesses, victims, court personnel, judges, jurors, medical personnel, forensic experts, news media and the general public. Assists law enforcement personnel of SCHP and FCSO in preparing cases for trial and training law enforcement to prosecute their own cases as the need arises, with the aid of other Assistant Solicitors. Recommends acceptance or rejection of pre-trial intervention program applications; directs those accepted to appropriate community service programs. Represents the state on all Magistrates court appeals. Performs related duties as required. Requires a Juris Doctor degree supplemented by 1 years of experience practicing law, or an equivalent combination of education, training and experience that provides the required knowledge, skills and abilities. Must be a member of the S.C. Bar Association, in good standing.
