Deputy District Attorney III
The candidate under limited supervision, investigates, prepares and prosecutes felony and misdemeanor cases for Butte County; represents the District Attorney in the management of legal issues, and all aspects of general felony prosecution. Represents the District Attorney in prosecuting persons charged with felony and misdemeanor criminal offenses; assures that cases are resolved within office policy guidelines. Reviews citations, arrest reports and other law enforcement documents; conducts factual and legal analysis to determine whether felony charges should be filed based on the facts of law and evidence. Conducts legal research; gathers and compiles evidence; identifies and subpoenas witnesses, records and other information required to present the case; prepares and presents memoranda of law, briefs and other legal documents as required. Reviews motions filed in cases, provides assessment and recommendations, and resolves as needed; receives and reviews memoranda, briefs and other filings; reviews filings for jurisdictional and statutory requirements; conducts conferences with defense counsel concerning settlement of cases. Manages assigned cases; advises law enforcement agencies; confers with witnesses and victims of crime; negotiates plea agreements with defense counsel; anticipates problems and pursues solutions; establishes trial strategy. Represents the District Attorney at Grand Jury proceedings; presents evidence and questions witnesses before the Grand Jury; identifies and develops written materials, exhibits and related trial presentations. Represents the District Attorney at trials; brings cases before the court; examines witnesses and argues facts of the case in relation to points of law, case law and legal precedent; develops and presents jury instructions and closing arguments; and manages sentencing hearings. Guides and assists paralegals, secretaries and clerks; provides training, counseling and professional assistance on legal writing skills and professional responsibilities. Advises law enforcement agencies during investigations; assists in the development of trial preparation and presentation skills for deputies and officers; responds to law enforcement agencies' inquiries regarding search warrants and charging decisions. Performs other related duties as assigned. A Juris Doctorate (JD) degree required. Must have 2 years relevant experience in a criminal trial practice. Must be licensed by the Bar to practice law in the State of California, remain active with all California Bar annual requirements.
